Welcome to ShoutSouthend. By accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and ShoutSouthend. Please read them carefully before using our service.
2. Eligibility
To use ShoutSouthend, you must:
- Be at least 18 years of age
- Be legally capable of entering into a binding contract
- Not be prohibited from using the service under applicable law
- Not have been previously banned from the service
Age Requirement: ShoutSouthend is strictly for users aged 18 and over. By using the App, you confirm that you are at least 18 years old. We reserve the right to request proof of age and to terminate accounts that violate this requirement.
3. Your Account
Account Creation
You must create an account to use ShoutSouthend. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorised access
Account Security
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
One Account Per Person
You may only maintain one active account. Creating multiple accounts may result in termination of all accounts.
4. User Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Harass, abuse, stalk, threaten, or intimidate other users
- Post or transmit content that is offensive, defamatory, or discriminatory
- Impersonate any person or entity
- Use the App to spam, advertise, or solicit other users
- Collect or harvest user information without consent
- Interfere with or disrupt the App or servers
- Attempt to gain unauthorised access to any part of the App
- Use automated scripts, bots, or other means to access the App
- Share sexually explicit or pornographic content
- Engage in any form of commercial activity without our consent
5. User Content
Your Content
You retain ownership of content you create and share on ShoutSouthend ("User Content"). By posting User Content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content in connection with the App.
Content Standards
You agree that your User Content will not:
- Contain nudity, sexually explicit material, or pornography
- Promote violence, hate speech, or discrimination
- Infringe on any third party's intellectual property rights
- Contain false or misleading information
- Include personal information of others without their consent
- Promote illegal activities or substances
Content Removal
We reserve the right to remove any User Content that violates these Terms or our Community Guidelines, at our sole discretion and without notice.
6. Safety Guidelines
Your safety is important to us. When using ShoutSouthend to meet people:
- Meet in public places for initial meetups
- Tell a friend or family member about your plans
- Trust your instincts - if something feels wrong, leave
- Do not share personal financial information
- Report any suspicious or concerning behaviour
Important: ShoutSouthend does not conduct criminal background checks on users. We cannot guarantee the conduct of users and are not responsible for interactions between users.
7. Intellectual Property
The App, including its original content, features, and functionality, is owned by ShoutSouthend and is protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute the App or its content
- Use our trademarks or branding without permission
- Reverse engineer or attempt to extract the source code
- Create derivative works based on the App
8. Termination
By You
You may delete your account at any time through the App settings. Upon deletion, your profile, photos, and data will be permanently removed.
By Us
We may suspend or terminate your account if you:
- Violate these Terms or our Community Guidelines
- Engage in illegal or harmful behaviour
- Create risk or possible legal exposure for us
- Have been inactive for an extended period
We may terminate accounts without notice for severe violations. For minor violations, we may issue warnings or temporary suspensions before permanent termination.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE
We do not guarantee:
- The accuracy of user profiles or content
- The conduct or intentions of other users
- That you will find matches or make connections
- Continuous, uninterrupted access to the App
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOUTSOUTHEND SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, goodwill, or other intangible losses
- Any conduct or content of third parties on the App
- Any interactions between users, whether online or offline
Our total liability shall not exceed the amount you paid to us, if any, in the 12 months prior to the claim.
11. Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any dispute arising from these Terms or your use of the App shall be resolved through:
- Informal Resolution: Contact us first to try to resolve the dispute amicably
- Mediation: If informal resolution fails, we may agree to mediation
- Courts: The courts of England and Wales shall have exclusive jurisdiction
12. Changes to Terms
We may modify these Terms at any time. When we do:
- We will post the updated Terms on this page
- We will update the "Last updated" date
- For material changes, we will notify you through the App
Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
